Florida is stricter than most states. Under chapter 767, Florida Statutes, "owners of dogs shall be liable for any damage done by their dogs to a person or to any animal." That liability extends to public property and to private property the victim was on lawfully — including the owner's own property — and applies whether or not the dog has a history of aggression.
If the victim's own negligence contributed to the attack, that comparative fault reduces the owner's liability proportionally.
The "Bad Dog" sign exception — and its limits
An owner can limit liability by displaying a clearly visible "Bad Dog" sign warning visitors of the risk. The exception doesn't apply to children under six. And even with a posted sign, an owner who was negligent — by act or omission — at the time of the bite remains liable.
