Under Florida law, an injured plaintiff has the burden of proving four elements: (1) the defendant owed a duty, (2) the defendant breached that duty, (3) the breach caused the injury, and (4) the injury caused real, compensable harm. Insurance carriers fight at every step — minimizing the injury, blaming a different cause, blaming the victim.
